Are you Paying Overtime Correctly? New State Law Mandates Double Damages

The Connecticut General Assembly has recently made changes to laws governing employee compensation. In this latest Bill (Senate Bill 914), the legislature mandates double damage awards in all instances where an employer failed to pay an employee properly for extra hours worked or failed to pay an adequate minimum wage.

There is a small piece of wiggle room in the new law. If an employer is able to demonstrate a good faith belief that they acted appropriately – the double damages provision will not apply. Full damages as well as court and attorney fees will however be the responsibility of the employer.

Will the Governor sign the bill? Yes – that’s expected. And if that happens – the law will take effect in October 2015.
